Vendor Terms and Conditions

These Vendor Terms and Conditions (hereinafter referred to as “Terms”) govern your use of the Living Earth Marketplace platform (hereinafter referred to as “the Website”) as a vendor. By creating a store and selling your goods or services on the Website, you agree to comply with and be bound by these Terms. Please read these Terms carefully before using the Website. If you do not agree with any part of these Terms, do not proceed with creating a store or selling on the Website.

  1. Vendor Registration
    • In order to become a vendor on the Living Earth Marketplace, you must create an account and complete the vendor registration process.
    • You agree to provide accurate and complete information during the registration process.
  2. Store Setup and Management
    • As a vendor, you are responsible for setting up and managing your store on the Website.
    • You agree to accurately describe your products or services and ensure that all information provided in your store listings is up-to-date and truthful.
    • You may not sell any prohibited items or engage in any illegal or fraudulent activities on the Website.
  3. Product Listings
    • You are solely responsible for the accuracy, legality, and quality of the products or services listed in your store.
    • You must comply with all applicable laws and regulations governing the sale of your products or services.
    • We reserve the right to remove any listings that violate our policies or are deemed inappropriate.
  4. Orders and Fulfillment
    • You agree to fulfill orders promptly and accurately.
    • You are responsible for packaging and shipping products to customers in a timely manner.
    • Any issues related to order fulfillment, including delays or errors, must be addressed promptly and professionally.
  5. Payment and Fees
    • You agree to pay any applicable fees or commissions associated with selling on the Website.
    • Payment processing fees may apply to transactions processed through our third-party payment processor.
    • We reserve the right to modify our fee structure at any time with prior notice.
  6. Compliance
    • As a vendor you are liable for any taxes, fees, registrations and other related compliance issues such as business registrations and permits which might be necessary for you to run a business.
  7. VAT
    • All prices displayed in your store are inclusive of VAT. You are liable to provide your customers with a Tax Invoice upon request. The marketplace does not collect VAT on your behalf.
  8. Customer Service
    • As a vendor, you are responsible for providing excellent customer service to buyers.
    • You must respond to customer inquiries and resolve any issues or complaints in a timely and professional manner.
  9. Returns and Refunds
    • You must have a clear and fair return and refund policy for your store.
    • You are responsible for processing returns and issuing refunds according to your store’s policy.
    • We are not responsible for processing returns or issuing refunds on your behalf.
  10. Intellectual Property
    • You retain ownership of the intellectual property rights to your products and store content.
    • By listing your products or services on the Website, you grant Living Earth Marketplace a non-exclusive, royalty-free license to use, reproduce, and display your content for the purpose of promoting and operating the Website.
  11. Compliance with Laws
    • You agree to comply with all applicable laws and regulations governing your use of the Website and the sale of your products or services.
  12. Termination
    • We reserve the right to suspend or terminate your vendor account and store at any time for any reason, with or without cause.
  13. Changes to Terms
    • We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Website after any such changes constitutes your acceptance of the new Terms.
  14. Governing Law
    • These Terms shall be governed by and construed in accordance with the laws of Namibia, without regard to its conflict of law provisions.
